Oliver Martinez, who was married to the Oscar winner from 2013 to 2015, filed a temporary restraining order against her on Oct. 1, requesting sole custody of their 13-year-old son Maceo, accusing Berry of abuse
The actress denied his accusations in an Oct. 5 declaration stating she has “never physically, emotionally, or otherwise abused Maceo”
Halle Berry was seen out following accusations of abuse from her ex-husband Olivier Martinez.
The actress, 60, who has strongly denied the accusations, was spotted in public on Oct. 15, two weeks after a Los Angeles County judge granted Martinez’s request for a temporary restraining order that covered both himself and the exes’ 12-year-old son Maceo.
Berry stepped out with her fiancé Van Hunt dressed in a black tee and yellow cargo pants with sunglasses. Hunt, 56, sported a denim jacket over a black tee and khakis. The two appeared to be walking through a parking lot.

In his Oct. 1 petition obtained by PEOPLE, Martinez, 60, alleged “instances of abuse over the course of the last few years” and that Berry caused him “emotional and mental distress due to physical abuse of our minor child, Maceo.”
In the filing, the French actor detailed an incident on Sept. 26 in which Berry allegedly “grabbed Maceo by the neck and started choking him while shouting, ‘Who is dominant now?! Who is dominant?’ ” Hunt was present during the alleged incident.
The filing includes alleged texts between the former couple at the time of the incident in which Berry said that Maceo “is disrespectful to me” and “I’m just money bags!” On Sept. 27, she allegedly texted Martinez, “I feel terrible about what happened last night as I know he does as well.”

Martinez also requested sole custody of Maceo in the filing. Berry and her third husband welcomed their son in 2013, filed for divorce in 2015 and finalized it in 2023 after a contentious eight-year battle. The Oscar winner also shares daughter Nahla, 18, with ex Gabriel Aubry.
The court granted Martinez’s request in part and denied it in part. Days after the petition, on Oct. 5, Berry filed a declaration in which she stated, “I have never physically, emotionally, or otherwise abused Maceo. I am a victim of domestic violence, and I help victims of domestic violence.”
She continued, “I am not a perpetrator of violence. I would never hurt our child.”

According to court docs, Berry was required to attend a court-ordered mediation session on Oct. 14. The Crime 101 actress now has unsupervised visits with Maceo twice during the week and every other weekend. Berry has asked to restore her former custody agreement from August 2023, in which Berry and Martinez shared 50/50 custody.
In court documents obtained by PEOPLE on Oct. 12, Martinez said that Maceo wants to address the court “to provide his side of the story” during the upcoming custody hearings.
In documents filed the next day, Berry objected to Maceo testifying, claiming that Martinez was dismissing statements from other key eyewitnesses, including Hunt and Nahla, who previously wrote in court docs that she had never seen her mom “physically abuse Maceo in any way.”
The mom of two went on to caution the court against placing “substantial weight” on the testimony of her teenage son, who she described as being a “coached and manipulated child.”
Despite Berry’s objection, according to court documents obtained by PEOPLE, Maceo will testify in his parents’ custody trial, per a court order by the judge. However, his testimony will be “limited to the request for an issuance of a restraining order.”
A hearing on the restraining order is set for Oct. 19.
Martinez’s lawyer Patrick Baghdaserians has said his client’s “paramount concern is the health, welfare and the safety of” Maceo. Berry’s attorney Marina Beck described Martinez’s filing as “entirely meritless and deliberately misleading.”
In May 2024, Berry and Martinez had agreed to “co-parenting therapy” with a coach to “resolve disputes and conflicts between them in an effort to successfully co-parent” Maceo, then 9 years old, according to docs obtained by PEOPLE.
Shortly after, a source told PEOPLE that the two have different approaches to parenting. “They have very different parenting styles,” said the insider. “Co-parenting hasn’t been easy. Still, they both love Maceo and he’s amazing...[he’s a] very focused student. Halle very much tries to keep his life private.”
